The list of holidays is national and applies exclusively to employees with a fixed schedule (5 working days – 2 days off). The calendar indicates on which days in 2016 there are official holidays throughout Russia. Standard working hours for 2016

The standard working time according to the time sheet for an ordinary employee with a fixed schedule (40 hours per week) per day is eight hours per day. If a person works 36 hours a week, his daily hours are 7.2 hours (36 divided by 5 working days).

In the case when a person works part-time, his working week is 24 hours and he works 4.8 hours a day (Order of the Ministry of Health of the Russian Federation No. 588 of August 13, 2009).

Rescheduled weekends and holidays in 2016

Article 112 of the Labor Code of the Russian Federation allows you to transfer days off that fall on holidays to another day. This is done in order to optimize not only the work schedule, but also to make optimal use of holidays.

According to this law, the following days are postponed in 2016 (RF Decree No. 1017, dated September 24, 2015):

  • the day off 01/02/16 (a holiday that falls on a day off) is postponed to 05/03/16;
  • the day off from 05/01/2016 is postponed to 05/02/2016;
  • 01.2016, the day off was moved to the seventh of March;
  • the twentieth of February, the day off has been moved to the twenty-second of February.

Thus, by postponing the weekend, the number of days allocated for May Day increases by three days instead of one and the celebration of Defender of the Fatherland Day from one day to three. Public holidays in 2016

According to Art. 112 of the Labor Code of the Russian Federation, non-working holidays in Russia are the following dates:

  • January 1, 2, 3, 4, 5, 6 and 8 - New Year holidays
  • January 7 - Christmas
  • February 23 - Defender of the Fatherland Day
  • March 8 - International Women's Day
  • May 1 - Spring and Labor Day
  • May 9 - Victory Day
  • June 12 - Russia Day
  • November 4 - National Unity Day

If a public holiday falls on a Saturday or Sunday, the day off is transferred to the next working day. In 2016, Spring and Labor Day (May 1) and Russia Day (June 12) fall on Sundays, so the weekend moves to Mondays May 2 and June 13, respectively.

The Government of the Russian Federation has the right to make changes to the production calendar, shift non-working holidays to other dates in order to rationalize the labor process (Article 112 of the Labor Code of the Russian Federation). For 2016, the following holiday transfers have been approved:

  • from Saturday January 2 to Tuesday May 3;
  • from Sunday January 3 to Monday March 7;
  • from Saturday 20 February to Monday 22 February.

Pre-holiday days

On the eve of official state holidays, working hours are reduced by 1 hour, the same for both a 40-, 36- and 24-hour five-day work week (Part 1 of Article 95 of the Labor Code of the Russian Federation). If a holiday falls on a Sunday, then the work hours on Friday are not reduced. In 2016, there are 2 pre-holiday days in Russia: February 20, November 3.

Working time standards for 2016 in Russia

The duration of a working day or shift with a 40-hour work week with two days off on Saturday and Sunday is 8 hours, with a 36-hour work week - 7.2 hours, with a 24-hour work week - 4.8 hours, on a pre-holiday day it is reduced by 1 hour .

According to the Russian labor calendar, in 2016 the country has 247 working days (including 2 shortened days) and 119 days off.

The first table is a regular calendar for the year, in which weekends and holidays are highlighted in bold (often in red) with a five-day work week and days off on Saturday and Sunday. Pre-holiday working days are also indicated here, when the working day is shortened by 1 hour. As a rule, such pre-holiday days are marked with an “*” (“asterisk”).

The production calendar, first of all, is a document for the personnel department and all employees responsible for and scheduling shift work.

When compiling a timesheet and calculating the total of hours and days, you need to check the production calendar to determine whether the employee has hours worked in excess of the norm. This is necessary for the correct calculation of wages, since according to the law, all overtime hours must be paid at increased rates. No less than one and a half times the tariff rate for the first two hours, and no less than double for all subsequent hours.

Calculating overtime hours worked is also necessary to comply with the law, which states that during the year an employee should not overwork more than 120 hours. Constantly counting overtime hours as a cumulative total, you can track the total of 120 hours. And if, for example, in the month of October an employee approached the 120-hour mark, then in subsequent months it will be illegal to involve him in work on weekends. Particular care should be taken in calculating overtime hours for employees with a shift schedule.

Using the production calendar, you can determine the amount of working hours in each month and compare it with the actual hours worked by a particular employee.

When calculating the minimum wage, you must remember to check the production calendar. If an employee has not worked the required number of hours in the current month, then the payment may be less than the minimum. Since the very definition of such payment says that in order to receive it you need to work the required hours. But if the employee has worked more hours, then payment for them must be made separately and be part of the minimum wage. It should also be remembered that the minimum wage does not include payment for overtime and holidays.

About holidays, pre-holidays and weekends

Holidays are established by Article 112 of the Labor Code of the Russian Federation. Currently there are 14 holidays in the Russian Federation:

  • January 1, 2, 3, 4, 5, 6, 8 – New Year holidays;
  • January 7 – Christmas;
  • February 23 – Defender of the Fatherland Day;
  • March 8 – International Women's Day;
  • May 1 – Spring and Labor Day;
  • May 9 – Victory Day;
  • June 12 – Russia Day;
  • November 4 is National Unity Day.

According to the law, all these holidays are non-working days. If a holiday coincides with a day off, the holiday day off is transferred to the next working day. Earlier, amendments were made to the Labor Code of the Russian Federation that allow two days of the New Year holidays to be transferred to any other month.

Pre-holiday day The working day immediately preceding the holiday is considered. According to the law, on these days the working day is reduced by 1 hour.

Day off is a day of rest for an employee, provided to him on the basis of legislation. Most often these are Saturday and Sunday, but with a shift schedule, a day off can be provided on any day of the week.

On what basis is it compiled?

The production calendar is compiled on the basis of the Decree of the Government of the Russian Federation on the transfer of weekends and holidays. For the 2016 calendar, such a Resolution was adopted in September 2015.

Since the period for the production calendar is a calendar year, transfers of holidays are carried out only within this year. That is, January 1, which falls on Saturday, is not transferred to Friday, December 31 of the previous year.

About postponing working days

According to the established procedure, a legal act establishing the transfer of weekends and holidays must be published in official sources no later than a month before the start of the new calendar year. Changes may be made during the year, but only if these changes are officially published no later than 2 months before the transfer date.

The transfer of holidays in 2016 was established by Government Decree of September 24, 2015 N 1017 - LINK.

Which days in 2016 will be holidays and weekends?

In 2016 there will be two pre-holiday days: February 20 and November 3. November 20 will be a pre-holiday day, since February 22 is postponed to it. Accordingly, in these two months the standard time for a 40-hour work week will not be a multiple of 8 and will be 159 and 167 hours, respectively, since working days before holidays will be 7 hours instead of 8.

Public holidays in 2016 will be the following days:

  • in January from 1 to 10;
  • in February from 21 to 23;
  • in March from 5 to 8;
  • in May from 1 to 3 and from 7 to 9;
  • in June from 11 to 13;
  • in November from 4 to 6.

The following days will be rescheduled:

  • January 2 and 3 to May 3 and March 7, respectively;
  • the working day of February 22 will be moved to Saturday February 20;
  • June 12 is moved to June 13.

Working time standards for different working week options

The bulk of the entire working population of our country works on a 5-day schedule with two days off and an 8-hour working day, corresponding to a 40-hour working week. But there are specialties and positions for which the state provides benefits in the form of a reduction in working hours. These are primarily teachers and medical workers, as well as some hazardous professions.

They can work on a 36-hour or 24-hour workweek.

For them, all norms of working hours are also calculated in the production calendar.

The number of weekends and non-working holidays together with in 2016 will be 139 days and will account for 40% of the total number of days in the year. And for some workers this ratio will be even greater, since there are professions for which additional leave is provided.

Examples of calculation: is an employee always entitled to payment for overtime hours worked?

Example 1

In January 2016, 15 working days and 120 hours. One of the guards worked 140 hours. Should the employer pay the increased rate for 20 hours?

Not always.

When working in shifts, accounting for normal duration can be determined in several ways:

  1. monthly accounting of time norms;
  2. quarterly accounting of time standards;
  3. annual accounting of time standards.

All these methods are called summarized recording of working hours.

What are their differences?

With the monthly standard of time, everything is clear; how much is required in a month, the employee must work that much.

With a quarterly standard of working time, the normal duration is not considered every month, but only once a quarter. And it represents the sum of time standards for three months.

Example 2

The standard time for the 1st quarter of 2016 will be 447 hours (January 120 + February 159 + March 168).

Watchman Ivanov A.A. worked:

  • January 140 hours;
  • February 150 hours;
  • March 155 hours.

Total for the quarter = 445 hours.

Therefore, in the 1st quarter it has no processing. “Surpluses” in January were compensated by “shortages” in February and March.

Example 3

Watchman Petrov V.V. worked:

  • January 150 hours;
  • February 150 hours;
  • March 165 hours.

Total for the quarter = 465 hours, with the norm being 447, that is, the overtime amounted to 18 hours. It is this that is paid at an increased rate, and not the January 30 hours.

The principle of annual recording of working time is similar, with the only difference being that the calculation point is the end of the year.

The same principle can be applied when calculating the minimum wage.

But to do this, it is necessary to establish in local regulations the period for recording working hours and be sure to draw up a work schedule for the entire period at once.

Even if you use annual or quarterly time tracking, holidays on working days still need to be paid double.
