○ What does the law say?

The circulation of precious metals is regulated by:

  • Law of the Russian Federation “On Currency Regulation and Currency Control” dated October 09, 1992 No. 3615-1.
  • Federal Law “On Precious Metals and Precious Stones” dated March 26, 1998 No. 41-FZ.
  • Decree of the Government of the Russian Federation dated June 18, 1999 No. 643 “On the procedure for testing and marking products made of precious metals” and other regulatory legal acts.

As a general rule, jewelry cannot be exchanged or returned. The seller should warn you about this when making a purchase. However, when purchasing this category of goods, the interests of buyers are also protected by the Consumer Rights Protection Law (hereinafter referred to as the Consumer Rights Protection Law).

Despite the fact that this law provides for the possibility of exchanging or returning goods of good quality, this does not apply to jewelry.

They are included in the “List of non-food products of proper quality that cannot be returned or exchanged for similar goods of other sizes, shapes, dimensions, styles, colors or configurations,” approved by Decree of the Government of the Russian Federation dated January 19, 1998 No. 55.

Therefore, you can return jewelry to the store only if it is found to be defective.

If defects are discovered in the product, if they were not specified by the seller, the consumer has the right to:

  • Request a replacement for a product of the same brand (same model and (or) article).
  • Request a replacement for the same product of a different brand (model, article) with a corresponding recalculation of the purchase price.
  • Demand a commensurate reduction in the purchase price.
  • Demand immediate, free of charge elimination of defects in the product or reimbursement of costs for their correction by the consumer or a third party.
  • Refuse to execute the sales contract and demand a refund of the amount paid for the goods. At the request of the seller and at his expense, the consumer must return the goods with defects (clause 1 of article 18 of the PZPP).

○ What should be included with the decoration?

In order to be able to return the product if defective, you must have appropriate documentation confirming the authenticity of the product.

Mandatory indication of the sample.

A seal is a special mark that is applied to a product made from precious metals. It consists of letters and numbers and indicates the quality of the alloy, which is determined by the ratio of the base metals in the jewelry. The presence of a seal guarantees that the product has passed state control and corresponds to the data indicated on it. Let's consider how to determine the meaning of numbers and letters on the selected decoration?

The numbers indicate the quality of the product and the percentage of gold content. The following types of samples are used in Russia:

  • 375 – gold content 38%.
  • 500 – gold content 50.5%.
  • 585 – gold content 58.5%.
  • 750 – gold content 75.5%.
  • 958 – gold content 95.38%.

The letter indicates the government inspectorate that supplied the sample.

Sealed tag.

A tag containing detailed information about the purchased product is attached to it with special seals from the manufacturer. This protects both the jewelry itself and the tag attached to it from counterfeiting. This is why it is so important to only buy jewelry that has a sealed tag, guaranteeing that the quality of the product corresponds to its stated characteristics.

In addition, this small piece of paper acts as the official certificate of the manufacturer and is a legal document. Therefore, if, when purchasing, the seller offers you to replace the tag with another document, this is a reason to be wary.

○ Can I return a ring or earrings within two weeks?

Jewelry cannot be returned to the store just because when you came home you realized that it did not suit you. This type of goods is not subject to the right of return within 14 days, which is enshrined in the PSA. By law, you can return a product only if it is defective. However, many stores accommodate customers halfway and give several days for a return or exchange. This is possible if, for example, the jewelry is purchased as a gift and the buyer doubts whether he got the right size. This possibility must be discussed before making a purchase.

○ Is there a warranty for jewelry?

The warranty for jewelry is established by the manufacturer and is indicated in the warranty card, which is issued when making a purchase. If it is not specified, you have the right to return the defective product within 2 years.

○ Which product is considered to be of poor quality?

In order for you to be able to get your money back or exchange the product for a similar one, the product must be found to be of poor quality. Let's consider how such a conclusion can be achieved.

Jewelry examination.

If disagreements arise regarding the quality of the goods, an examination is carried out, the result of which is an official conclusion. It is carried out by the seller.

In the event of a dispute about the reasons for the occurrence of defects in the goods, the seller (manufacturer), an authorized organization or an authorized individual entrepreneur, or the importer are obliged to conduct an examination of the goods at their own expense. The consumer has the right to be present during the examination of the goods and, in case of disagreement with its results, to challenge the conclusion of such examination in court (Part 3, Clause 5, Article 18 of the PZPP).

Who pays for the examination?

The seller pays for the examination, which is enshrined in Article 18 of the PPA. But if the results reveal that the detected defects were caused by the buyer, he is obliged to compensate the cost of the examination.

If, as a result of the examination of the goods, it is established that its defects arose due to circumstances for which the seller (manufacturer) is not responsible, the consumer is obliged to reimburse the seller (manufacturer), an authorized organization or an authorized individual entrepreneur, the importer for the costs of conducting the examination, as well as those associated with its implementation. expenses for storage and transportation of goods (part 4, clause 5, article 18 of the Labor Code).

Duration of the examination.

The amount of time that will be spent on the examination is determined by the presence of specific claims and the complexity of the procedure. On average, it takes from 10 days to a month. The warranty period for the product is extended for the period required for the examination.

Buying jewelry is usually expensive. Therefore, you want the jewelry to be of high quality and to delight you with its beauty for a long time. Or maybe they even became a family heirloom. But in stores, under the light of bright lamps, an abundance of mirrors and luxurious glitter, it can be very difficult to notice what is visible to the naked eye at home.

Imagine the disappointment when the chosen decoration did not fit, was not liked, or turned out to be defective. Jewelry is often purchased as a gift. And then it turns out that the ring is too big, the color of the stone is not yours, the bracelet scratches your hand, or the necklace doesn’t match the dress.

But there is one caveat.

If you purchased jewelry through an online store, you have the right to return it for reasons: you didn’t like it, it didn’t fit, it was the wrong color, etc. (Clause 4 of Article 26.1 of the Law on the Protection of Consumer Rights). You have seven days to do this, subject to compliance with the return requirements (sales presentation, packaging, tags, documents, etc.).

By law, the manufacturer must establish a warranty period for jewelry. Usually it ranges from 6 months to two years, but most often a year. It all depends on the type of decoration. During this period, you can count on warranty service in the store if the product is damaged or something happens to it. For example, if a stone falls out or a clasp breaks, you will have to have it repaired. In this case, it should not be your fault. If a defect is suspected, the store takes the product and conducts an examination. High-quality jewelry cannot be exchanged.

Surprisingly, returning jewelry to an online store is completely legal and possible

If you damage the jewelry as a result of impact or improper handling, the warranty does not apply. Although some sellers have promotions to replace the product with a new one, even if the damage occurred through your fault within, for example, a month.

Moreover, many large chains value their reputation and always meet consumers halfway; they can even exchange jewelry if the size is not right. But that doesn't mean they should do that.

If you brought a product of proper quality, the store has the right to refuse to replace or return you. But sometimes, as an exception, you can return the jewelry to the store - check all the conditions before or during the purchase.

Sellers can be cunning and make a warranty less than that of the manufacturer. It is worth clarifying this point in advance. Do not throw away receipts, certificates and tags until the end of the warranty, or even better, within two years.

Because according to the law, if you discover a significant or irreparable defect in the product before the end of two years, you can demand a replacement or refund even for jewelry (Clause 6 of Article 19 of the Law on the Protection of Consumer Rights). Just keep in mind that you will need to prove that the defect occurred before the transfer of the goods, and it is not your fault.

If the jewelry is damaged as a result of impact or improper handling, the warranty does not apply, which is quite fair.

Exchange or return of jewelry

So, you can return or exchange jewelry only in the case of a manufacturing defect, an irreparable or significant defect that arose due to the fault of the seller or manufacturer. That is, you were sold a product of inadequate quality. There may be a situation here when you bought 585 gold, but in fact it is gilding or even an alloy. In this case, you should receive a refund or a replacement at your request.

You go to the store and write a statement. The seller does an examination and, upon confirmation of the defect, either changes or returns the money - as you request. If you make a replacement and the new jewelry costs less, you should be refunded the difference. The money is returned within 10 days (Article 21-22 of the Law on Protection of Consumer Rights). Usually the procedure for returning jewelry is the same everywhere.

It rarely happens that the seller does not want to accept the jewelry and do an examination. But if you encounter this problem, write a complaint with a detailed description of the detected defect, clearly stating your requirements, and contact the store. Write your claim in two copies (if you write by hand, just make a copy). Keep one copy for yourself; it should bear a signature with a transcript and the position of the person who accepted it, the date and seal of the store (if an individual entrepreneur is not required).

If the store has made an examination with which you do not agree, you can contact an independent expert. The seller will be obliged to reimburse you for all costs of an expert opinion in your favor (manufacturing defect). Otherwise, you will have to reimburse the seller at his request.

Buying jewelry is a holiday for any woman, due to its high cost. Ladies tend to try on gold or silver jewelry for hours, and excesses with its exchange and return still happen, and not only if the product simply did not fit.

Will the jewelry be accepted in the store within 14 days?

Is it possible to exchange a gold ring if it doesn't fit? What about the earrings that your beloved mother-in-law didn’t like? Agree, this situation occurs quite often, especially when jewelry is purchased as a gift, for example, on the occasion of an engagement or a birthday.

Is there a way out of the sticky situation, because the sellers accept the shoes, even if they just don’t like them?

Unfortunately, it is impossible to return a piece of jewelry to a store if you have no complaints about its quality. This is evidenced by the list of goods given in the Government Decree. It includes purchases that cannot be exchanged, even within 14 days from the date of purchase.

Quote! “Items made of precious metals (gold, silver, platinum and their compounds) and using precious or semi-precious stones, of good quality and purchased in a retail chain, cannot be replaced with similar ones or returned to the seller.”

Important! The safety of seals, labels and sales receipts does not give the buyer the right to exchange the jewelry or insist on a refund for an incorrectly selected purchase.

Why such difficulties? Experts explain this by 2 factors:

  1. It is possible that the item brought for return or replacement will turn out to be counterfeit. The seller, even with the use of chemical reagents, cannot always determine that in front of him is a skillfully made costume jewelry - a copy of the ring that was purchased yesterday as a gift. Obviously, the same product will be on display again tomorrow and will be purchased by a new consumer.
  2. Such especially valuable products almost never fall in price. On the contrary, it can become more expensive every day. It is not profitable for the store to follow the whims of the buyer and lose profit on sales.

It is clear that the law allows the return of jewelry only if it turns out that initially (at the time of purchase) it was of inadequate quality.

Conditions for replacing a defective gold item

Are products subject to return if the consumer identifies them as defective? Within what period can a claim be made to the seller?

Good news awaits jewelry lovers here. The Consumer Protection Law allows the exchange and return of jewelry if it is proven that it has a manufacturing defect rather than an operational defect.

If a stone falls out of the ring, and the gold chain just breaks on the neck, the store administration is obliged, in accordance with Art. 18 profile law:

  • carry out warranty repairs of the product within 45 days;
  • return the money for the product after receiving the defective item back;
  • replace the jewelry with a similar one, but of satisfactory quality and size that is suitable;
  • replace the ring or bracelet with the same jewelry, but of a different model and with recalculation of the cost.

So, the fact that you can exchange gold and silver products, even if only defective ones, is great. But there is one thing... Returning jewelry with defects is acceptable, but the responsibility to prove the cause and nature of the damage lies only with the buyer, and only an examination can confirm or refute the consumer’s case.

Important! If the research shows that stones fell out of the newlyweds’ gold wedding rings or other jewelry due to the negligence of their owners, it will be impossible to return these things to the store and get money, because returning jewelry that was of good quality at the time of purchase, as the laws say, is impossible .

They can be repaired under warranty if it has not expired, but more on that later.

Note! If the examination proves a manufacturing defect in jewelry that fits, the store will have to return the money not only for the purchase, but also compensate for the cost of the analysis.

Warranty service for jewelry

How long is the warranty on jewelry? Will this information help us sell the low-quality jewelry or at least repair it for free?

OST 117-3-002 of 1995 indicates that the warranty period for this category of goods is six months. This time is provided to the consumer to identify hidden manufacturing defects in jewelry products.

Nevertheless, salons have the right to increase the warranty period at their discretion and extend it until the end of the item’s service life. For jewelry this is 10 years.

Important! Of course, you can try to have a gold chain repaired during such a long warranty, but again, the workshop will require an independent examination of the item to prove its hidden flaws.

You can hardly be sure that after 2 years of continuous wearing, you carefully opened the clasp, and your child did not tug on the product.

Factory defects, as a rule, appear already in the first month of operation, so do not waste time, nerves and money on empty evidence if you are not absolutely sure that you are right.

Remember that jewelry may, by law, come with a manufacturer's warranty.

What to do with non-precious jewelry

Costume jewelry is products made from inexpensive metals, alloys or their compounds that imitate precious ones. There are many such things - they are beautiful, inexpensive and, sometimes, wear no worse than the original.

Is it possible to return jewelry to the store if it turns out that several stones fall out of a ring that is the right size? Is it possible under the law to have the same approach to counterfeit and jewelry in this matter?

Stores are required to accept jewelry back, since consumer protection laws and other regulations do not include it in the list of items that cannot be returned or exchanged. It is impossible to counterfeit, therefore the circulation of costume jewelry is carried out on the same basis as other goods and is not subject to the rules for returning jewelry by law.

Important! Items with gold or silver plated are classified as costume jewelry, so they are not subject to the rules according to which jewelry cannot be returned. Returns should be processed immediately after defects are discovered. If the defect is noticeable, the goods can be returned by law within just 14 days. If the defect is hidden, you must return the item within 6 months. The manufacturer sets a warranty period during which goods of poor quality can be returned. If the manufacturer has not established a warranty, the seller has the right to indicate it directly. This is the reason why return periods may vary. Warranty service often includes adjusting rings, setting stones, polishing, cleaning, etc.

If the manufacturer or seller has established a warranty for the product for less than 2 years, the buyer has the right to contact the seller, importer, or manufacturer within 1 year from the date of purchase.

The manufacturer sets the warranty period independently, taking into account that the service life of the jewelry does not exceed 10 years.

What jewelry can I donate?

The law defines the following grounds for the return of jewelry:

  • you bought a gold or silver item, for example, a chain or bracelet, but noticed defects - the chain broke (not as a result of careless handling), the lock does not work well, the links are dangling, the clasp is broken, the lock on earrings or chains has stopped working;
  • Inserts fall out of the jewelry, precious stones are poorly secured in the rings;
  • the sample of the product does not correspond to the real one;
  • Mechanical defects and chips were found on metal elements;
  • The bracelet of a watch bought in a jewelry store or the mechanism has broken, the watch has stopped running, etc. The warranty is not valid if the product is damaged due to the fault of the buyer, for example, as a result of an impact or other careless actions.

How to make a return if you find that the sample is not true, because the quality of the jewelry may still be correct? Jewelry can be returned if the sample on it is indicated incorrectly. A gold-plated silver ring sometimes has a gold ring hallmark. This is how sellers and manufacturers cheat. Dishonest sellers can pass off a 375 ring as 585. Non-compliance can be proven through an examination. Any pawnshop provides this service for silver and gold jewelry, but you need to take into account that only the Assay Chamber of the Russian Federation issues an official conclusion on the discrepancy between the sample and the reality.

When do jewelry stores have the right to refuse a refund?

The buyer may violate the rules established by law, which leads to refusal to exchange and accept the goods:

  • requesting an exchange or return of gold or silver products after the end of the warranty period;
  • the defect appeared after purchase;
  • deadlines were not met (the 14-day return period, warranty period, service life have expired).

If the buyer complies with the norms established by law regarding the exchange and return of goods, the seller is obliged to satisfy the buyer's requirements. Unreasonable refusal by the seller is grounds for filing a complaint.

Consumer rights Protection

The Government of the Russian Federation establishes the terms of trade in gold and silver jewelry, which a jewelry store must follow when selling goods. Requirements that a jewelry seller must fulfill:

  • The cash register receipt must contain information about the sample, product article, type of purchase, and information about the gemstone. If the cash receipt does not contain such data, the seller is obliged to issue a sales receipt indicating a detailed description of the jewelry;
  • weighing of jewelry is carried out in the presence of the buyer at his request;
  • gold or silver jewelry with precious stones are sold in special packaging;
  • the presence of a state guarantee - an assay mark on each imported or domestic product. The law allows not to place a hallmark on gold and silver jewelry weighing up to 3 grams;
  • precious stones - emeralds, diamonds - can only be sold if there is a certificate;
  • Russian products must have name stamps;
  • Before putting the goods on display, the seller is obliged to inspect it, check the sample, name tag, labels, seals, and make sure there are no defects.

Each piece of jewelry must have a label with the following information: name of the piece, manufacturer, type (silver or gold), purity, processing method, article number, weight, price.

If the product contains a stone that does not belong to the group of precious stones, information about this must be indicated on the label.

Procedure for getting a refund for a defective product

If you want to return a low-quality jewelry item to the store, follow these steps:

  • Please submit your requirements to the seller in writing in the form of a claim. Attach copies of the payment receipt, label (if any), tags;
  • If you accidentally throw away a check, this does not mean that the money cannot be returned. The fact of purchase can be confirmed by witnesses, or you can request video recording in the store;
  • If the store considers it necessary to find out the cause of the defect, an examination will be appointed. The buyer has the right to attend it, and if he does not agree with its results, he can contact an independent expert at his own expense. At the buyer’s initiative, it is more expedient to conduct an examination during the legal process.

The seller considers the claim within 10 days. If after this period you receive a refusal, the store does not make contact, and you have lost hope of solving the problem peacefully, you should go to court.

In addition to the return of amounts spent on the purchase of defective goods, you can demand compensation for moral damage through the court. When satisfying the claim, the court will also impose a fine in the amount of 50% of the cost of the claim. This money will go to the federal budget.

Collection of penalties

If the case goes to court, the plaintiff has the right to demand not only a refund of the amount for the defective product, but also a fine of 50% of the purchase amount. You can also receive a penalty for each day of non-return of funds, which compensates for the violation of consumer rights. To do this, you need to write a claim to the seller demanding compensation for losses and lost time.

Who calculates the penalty and how? The amount of the penalty is calculated independently. If the seller does not replace the goods within 7 days from the date of presentation of the demand, from the 8th day a penalty in the amount of 1% of the cost of the goods can be charged. If the goods are sent for examination, the consideration of the claim is 20 days, the calculation must begin from 21 days after delivery of the written demand. In this case, the countdown of the first day allotted for consideration of the claim must begin not from the moment the letter is delivered, but from the day following this day.

A legal dispute to protect consumer rights is carried out entirely at the expense of the seller. You will not have to pay a state fee when filing a claim.

The case will be heard by the court at your place of residence, but if it is more convenient for you, you can file a claim with the court at the location of the defendant. A quantitative indicator of the content of pure gold in an alloy is the sample; it is always indicated on the factory product, on the inside. Currently, gold products with a purity of 583 and 375 are on sale. Accordingly, this is the number of grams of gold contained in 1000 grams of the alloy.

In law, exchange the ring if the size does not fit, and at the same time in it no factory defects, impossible. The situation is completely different with jewelry, in which it was revealed:

  • Inconsistency of labeling with the product (for example, a gold-plated ring was sold and labeled as gold);
  • There is no hallmark on the product;
  • The ring has defects due to the fault of the manufacturer or seller.

In these cases, the buyer has the right return the gold ring to the store during the warranty period and demand your choice:

  1. Replacement of a product with another product similar in quality, raw materials, consumer and price parameters;
  2. Refund of money and termination of the contract;
  3. A proportionate reduction in the price agreed with the seller;
  4. Repair and restoration of the quality of the goods at the expense of the seller.

If the seller does not agree to fulfill the stated requirements, you can go to court, having previously prepared the appropriate independent expert opinion. You can prove that the ring was purchased in this particular store using a cash receipt or sales receipt, a warranty card with the seller’s details, and also with the help of witness testimony.

Jewelry return policy

In addition to expensive metals, jewelry can be made from inexpensive materials:

  • Plastic;
  • Aluminum;
  • Glass;
  • Trees;
  • Mixed and synthetic materials.

These products have different sales rules. In particular, according to Art. 25 of the Law on the Protection of Consumer Rights, you can exchange the ring for a similar product, even if the purchased product has no defects. The basis for return is the non-conformity of the goods in size, style, color and configuration. The period allotted for returning a good-quality ring is 14 days from the date of purchase. In this case, the product must be in marketable condition, with the label, sales receipt and other accompanying documentation intact.

Second reason return the ring to the store– this is the presence of manufacturing defects. As with jewelry, items may be returned to the seller during the warranty period if there are obvious or hidden defects. The procedure for justifying claims remains the same, regardless of the cost of the jewelry.
